El trabajo expone, analiza, y evalúa los datos de una nueva fuente sobre las visiones jurídicas de los ‛ulamā’ con respecto al estatuto islámico de las comunidades islámicas bajo dominio cristiano en la Península Ibérica desde el siglo XII hasta el siglo XVI. Se trata de una fetua desconocida e inédita del sabio andalusí Ibn Rabī‛ y fetuas desconocidas de los principales cadíes de los cuatro madhabs sunníes en El Cairo hacia 1510 A.D. Muy probablemente, hay que relacionar la primera (...) fetua con los acontecimientos en Murcia tras la sublevación mudejar de 1265 y la reconquista cristiana de la ciudad en 1266. El muftí subraya que los musulmanes que viven bajo dominio cristiano están imperativamente obligados a emigrar a territorio islámico. Los principales cadíes de los cuatro madhabs sunníes en El Cairo al principio del siglo XVI, sin embargo, defienden un modo de ver mucho más pragmático. Probablemente, las preguntas fueron planteadas por mudejares de Valencia, que estaban en El Cairo camino de la peregrinación. Finalmente, los autores plantean que hay que distinguir dos tipos coexistentes de visiones con respecto al estatuto del Islam bajo dominio cristiano en la Península Ibérica desde principios del siglo xii; una visión pragmática, equivalente a un reconocimiento de facto del Islam bajo dominio cristiano, y una visión «de rechazo», que asume la obligación de emigrar de la España cristiana a Dār al-Islām. El impacto variable de estas visiones jurídicas merece un estudio más profundo dentro del ambiente histórico de las complejas y cambiantes relaciones políticas entre Islam y Cristiandad en esa época. Este artículo está dedicado al famoso pergamino encontrado en 1588 en el antiguo minarete de la que había sido mezquita aljama de Granada, con textos en árabe, latín y castellano. Junto con los libros plúmbeos descubiertos en diversas cuevas a las afueras de la ciudad entre 1595 y 1600, el pergamino está en los orígenes de un importante culto nacional. El artículo presenta un análisis de la composición y escritura del pergamino y pasa revista a las trascripciones y traducciones que (...) se hicieron por testigos cristianos y musulmanes . Éstas se comparan críticamente con los principales elementos del pergamino y se discuten los comentarios paleográfícos hechos por estos testigos contemporáneos . Como conclusión, los autores mantienen que el documento transferido desde el Vaticano en el año 2000, es el original encontrado en 1588 a pesar de lo incomprensible de los textos árabes y de la corrupción de los textos castellano y latino Según los autores, no hay base para considerar al pergamino como documento proto-islámico, puesto que se trata de un mensaje católico romano anunciando la destrucción del islam. Al mismo tiempo, el documento incluye un mensaje simbólico al mostrar que los cristianos granadinos del siglo I, incluyendo a Cecilius, escribían árabe y castellano, lo mismo que hacían los moriscos. Así, aunque el Islam había de ser extirpado, la lengua árabe se podía armonizar con una vida genuinamente cristiana. (shrink)

Este artículo tiene por objeto dar una versión diferente y más breve del poema que contiene una demanda morisca de ayuda al Imperio Otomano, poema estudiado por James Monroe en Al-Andalus XXXI, 281-303. Esta versión indica que había habido otra demanda similar por parte de los moriscos al sultán mameluco de El Cairo, y que ésta era la original. El artículo contiene: 1) un análisis comparativo de las versiones de la casida dirigidas a los mamelucos y a los otomanos, 2) (...) el marco histórico de las relaciones entre los reinos cristianos y musulmanes de la Península Ibérica por un lado y los territorios mameluco y otomano por otro, y 3) una discusión de la fecha de las dos versiones de la casida, así como su autoría. Parece probable que el autor de la casida perteneciera a círculos de musulmanes granadinos que habían formado parte de las clases dirigentes de Granada y que luego habían aceptado puestos en la administración cristiana de la ciudad, como son, por ejemplo, varios miembros de la familia al-Baqannī, algunos de los cuales habían emigrado con Ibn al-Azraq al Norte de África, pero regresaron para integrarse en los grupos dirigentes mudéjares. The text of the tract De arcubus similibus was published for the first time by M. Curtze in 1887. However, after examining some more Latin manuscripts and the Arabic MS Oxford, Bodleian Library, Marsh 663 it appeared, that Curtze's edition was rather an adaptation. Also Curtze's suggestion that Jordanus Nemorarius was the author was very probably wrong. The author of the tract was the Egyptian mathematician Ahmed ibn Jusuf as appears from the Latin manuscripts, and its translator, very probably, Gerard (...) of Cremona. In the tract Ahmed tried to prove, that the assertion ‘similar arcs are also equal arcs’ was wrong . His starting points were the propositions Euclid III, 20 and 21. Consequently, the tract can be looked upon as a commentary on the third book of the Elements. (shrink)

In terms of Groenendijk and Stokhofs (1984) formalization of exhaustive interpretation, many conversational implicatures can be accounted for. In this paper we justify and generalize this approach. Our justification proceeds by relating their account via Halpern and Moses (1984) non-monotonic theory of only knowing to the Gricean maxims of Quality and the first sub-maxim of Quantity. The approach of Groenendijk and Stokhof (1984) is generalized such that it can also account for implicatures that are triggered in subclauses not entailed by (...) the whole complex sentence. Lara Buchak argues that her version of rank-weighted utilitarianism can accommodate an implication of the separateness of persons known as “the shift,” since it requires individuals to be more willing to accept risk for themselves than to accept inequality in society. I argue that this is mistaken. Buchak’s model fails to yield the shift when the decision-maker is distinct from the affected individual, as well as in certain social decisions where the risk attitude of the group is known. ### ­ In Who shall go first? A multicriteria approach to patient selection for first clinical trials of cardiac xenotransplantation, Kögel et al recommend the inclusion of patients who (1) have a (high) medical need for an allograft, (2) have the capacity to benefit from a xenograft, (3) have a ‘real’ choice between enrolment in a first-in-human clinical trial and an alternative life-sustaining treatment option and (4) have no clear record of previous non-compliance.1 As the authors discuss, patient selection must (...) promote the goal of gaining reliable and valid knowledge about the risks and benefits of cardiac xenotransplantation. While the four criteria outlined above certainly promote this goal, we argue it is crucial to add a fifth criterion emphasising the need to include diverse populations, particularly regarding sex, age, ethnicity and socioeconomic background.i In this commentary, we present two arguments for our claim and discuss the impact of neglecting diversity from the first trials on. ### The scientific rationale for including diverse populations First, including diverse populations in the first clinical trials of cardiac xenotransplantation enhances the scientific value of the data by assessing safety and efficacy among various populations. The question of human control is a key concern in autonomous military systems debates. Our research qualitatively and quantitatively investigates values and concerns of the general public, as they relate to autonomous military systems, with particular attention to the value of human control. Using participatory value evaluation (PVE), we consulted 1980 Australians about which values matter in relation to two specific technologies: an autonomous minesweeping submarine and an autonomous drone that can drop bombs. Based on value sensitive design, participants were (...) tasked to enhance the systems with design features that can realize values. A restriction (limited budget) in each design task forced participants to make trade-offs between design options and the values that these options realize. Our results suggest that the ‘general public’ has diverse and nuanced stances on the question of human control over autonomous military systems. A third of participants that is opposed to autonomous military systems when asked directly, selected different combinations of design features realizing varying degrees of human control. Several contextual factors, technology-specific concerns, and certain values seemed to explain these different choices. Our research shows that a focus on human control might overlook other important values that the general public is concerned about, such as system reliability, verifiability, and retrievability. Despite its basically syllogistic character, Richard Whately's Elements of logic presents the subject in a modern theoretical setting. Whately, for instance, regarded logic as an abstract science, and defined the syllogism as a purely formal device to be used as a means of determining the validity of all arguments. In this paper, I argue that such instances of abstractive ascent place Whately's theory in closer proximity to later 19th-century developments than to the work of his 17th-century predecessors. Although the potential of boredom has been part of the Christian tradition from its very beginning, the experience of boredom among adult believers has often been stigmatized or silenced. In this paper I explore the ‘politics of boredom’, suggesting that the experience of boredom within faith communities may be a form of minority stress, indicating that sub-groups do not find themselves represented in the shared narrative and practice. I argue that while many disciplines, including psychology and theology, have a tendency (...) to problematise those who are bored, it may be more fruitful to change this scope and investigate the boring. As an example I explore a feeling I call ‘Jesus fatigue’; the sense of being tired with the repetitive narrative investment in Jesus as a figure of inclusion, while actual inclusion is continuously postponed. I then discuss the subversive potential of ‘the yawn’, the open display of boredom, as a possible theological intervention that confronts tradition with its implicit exclusionary tendencies. The aim of this article is to provide a preliminary ethical evaluation of the effect of telesurgery on patient care. In order to accomplish this task we give a broad description of the state of the art in telesurgery and analyse it using Joan Tronto’s articulation of care as a structured process. This structure illuminates the significance of the patient-physician relationship as the buttress for establishing and preserving practices of care in the healthcare context, with the ultimate goal of safeguarding (...) patient dignity. The process of care combined with the moral aim of medicine—to fulfil the good of the patient—provides the ethical foundation for assessing telesurgery. By exploring various telesurgical scenarios we may assess its potential role in augmenting or diminishing patient care within the frame of the patient-physician relationship. The significance of conducting this evaluation lies in the fact that the practice of telesurgery may very shortly become routine and an evaluation has not yet been attempted. (shrink)

TheJournal of Medical Ethicspreviously published on the debate in the UK and the Netherlands concerning the legal age limits imposed on donor-conceived people for access to information about the identity of gamete and embryo donors. In that publication, three arguments were foregrounded against lowering these age limits as a general rule for all donor-conceived people. In this contribution, we engage with these arguments and argue why we think they are insufficient to maintain the age limits. In contrast, we argue for (...) a more suited, contextual and relational ethical framework based on care ethics, which emphasises relational autonomy and its dynamic, contextual development. This framework, we argue, provides a comprehensive approach for the analysis we made of the question of age limits and was applied in research performed in the Netherlands, commissioned by the Dutch Minister of Health. The framework enabled us to weigh the multidisciplinary—legal, psychological, phenomenological and ethical—findings of our research. (shrink)

Brouwer and Weyl recognized that the intuitive continuum requires a mathematical analysis of a kind that set theory is not able to provide. As an alternative, Brouwer introduced choice sequences. We first describe the features of the intuitive continuum that prompted this development, focusing in particular on the flow of internal time as described in Husserl's phenomenology. Then we look at choice sequences and their logic. Finally, we investigate the differences between Brouwer and Weyl, and argue that Weyl's conception of (...) choice sequences is defective on several counts. (shrink)

A new system of dynamic logic is introduced and motivated, witha novel approach to variable binding for incremental interpretation. Game logics describe general games through powers of players for forcing outcomes. In particular, they encode an algebra of sequential game operations such as choice, dual and composition. Logic games are special games for specific purposes such as proof or semantical evaluation for first-order or modal languages. We show that the general algebra of game operations coincides with that over just logical evaluation games, whence the latter are quite general after all. The main tool in proving this is a representation (...) of arbitrary games as modal or first-order evaluation games. We probe how far our analysis extends to product operations on games. We also discuss some more general consequences of this new perspective for standard logic. (shrink)

This paper addresses the application of positioning theory, a new emerging theoretical scheme on the issue of cultural stereotyping. First, a critical conceptual analysis of the words‘cultural stereotype’is presented. Secondly, the basic tenets of positioning theory are outlined. Finally, it will be demonstrated how the framework of positioning theory can be used to analytically refine the concept of cultural stereotype. The main upshot of the article is that within social psychology, the concept of cultural stereotype is used in a conceptually (...) vague and blurred way and that, with the necessary conceptual refinements, other research-agendas on stereotypes will have to be tackled if social psychologists want to contribute anything to the societal efforts of changing stereotypes.
